The Sindh High Court has given its verdict in the right-of-way and land allotment case on the dispute over the land ownership of M Nine Motorway and collection of toll tax.

The High Court in Karachi disposed of the petitions related to the M Nine Motorway. The Sindh High Court sent the matter to the competent authorities of the Sindh government.

The apex court directed the NHA to send a formal reference to the Sindh government and ordered the competent authority to take a decision after hearing all the parties within 45 days.

Until the court decision, the current status of the court related to M Nine Motorway will remain.

The apex court said that all the parties, NHA and the affected persons are allowed to present their stand in the court.

The lawyer of NHA said that the Sindh government had given the lease of land for the highway to the National Highway Authority in 2012, this lease was canceled in 2017 which is against the law.

While Sindh government’s lawyer said that the land always belongs to the province, the NHA is selling the land in the name of access, the transfer of land to the authority has been cancelled.

Sindh government’s lawyer further said that the authority cannot collect toll tax without paying the land price.

NHA’s lawyer said that the Sindh government wants to collect toll tax by taking over the Sindh Motorway.
