Federal Constitutional Court In the case of prisoners being treated at Konji Hospital The records of the founder PTI’s case were sought from the Supreme Court.
A 3-member bench headed by Chief Justice Aminuddin Khan heard the case of providing treatment facilities to prisoners in a private hospital in the Federal Constitutional Court.
During the hearing, the Attorney General has said that the Federal Constitutional Court should also request the record of the PTI case from the Supreme Court. Under Article 175E, the Federal Constitutional Court can request the record of any court in the country on the question of constitutional interpretation.
Justice Aminuddin Khan said that the petitioner says that the constitution and law should be applied equally to the rich and the poor.
Justice Ali Baqir Najafi asked the Attorney General whether he had raised an objection in the Supreme Court.
The Attorney General told the court that the Supreme Court gave us the order without issuing a notice, Additional Attorney General Aamir Rehman had raised the objection in the Supreme Court.
Justice Ali Baqir asked whether the Supreme Court should not have decided the issue of admissibility of the application?
The Attorney General replied that it is so, the power of constitutional interpretation now rests with the Federal Constitutional Court.
Justice Amir Farooq said that the case pending in the Supreme Court is of a criminal nature, the case has come to us against the decision of the Islamabad High Court, the order of the Supreme Court is still interim.
Justice Ali Baqir Najafi said that the real question is the jurisdiction, the question is who can hear the case of constitutional interpretation and fundamental rights now?
After which the Federal Constitutional Court sought the record of the founder PTI’s case from the Supreme Court.
The Federal Constitutional Court also sought the records of such cases in the Supreme Court and other High Courts.
The court has ordered that the record of any such case pending in any high court should be sent.
